Vice-Chairman of the Association of Indonesian Forest Entrepreneur (APHI), Irsyal Yasman said, the current investigation has been conducted by the National Environment Agency (NEA) Singapore to HTI companies which have become industrial raw material supplier of pulp and paper products in Indonesia.
"Company's raw material suppliers of pulp and paper industry is currently being investigated by NEA Singapore. Though the company is incorporated in Indonesia which should be subjected to the provisions under the legal jurisdiction of Indonesia," said Irsyal Yasman in a press release.
According to him, the Singapore government refers to Singapore Transboundary Haze Pollution Act No. 24, 2014 (STHPA 2014), which regulates the civil and criminal penalties against companies that cause or contribute to the pollution of smoke in Singapore. Whether it be inside or outside Singapore.
He said Indonesia has ratified an agreement of Asean Agreement on Transboundary Haze Pollution (AATHP) which refers to Law No. 26 2014. In Article 27 it is stated that the settlement of disputes between the parties regarding the interpretation, application or fulfillment of this agreement or protocol, must be resolved peacefully.
"Based on the principle of sovereignty, extraterritorial provisions set out in the 2014 Singapore STHPA, can be done by a country if it is based on agreements with other countries as stipulated in international treaties," he said.
Currently, the Government of Singapore and Indonesia have agreed AATHP, which emphasizes the principle of negotiations in solving the problems related to the interstate smoke.
"The Indonesian government is currently intensively to conduct an investigation on companies operating in Indonesia that indicated experiencing forest fires. Therefore, the Singapore government should respect the national law enforcement the principle of the sovereignty of Indonesia, "he explained.
The products produced by the pulp and paper industry from Indonesia is an excellent product marketing to reach more than 120 countries on five continents. Indonesia is currently the world's sixth and ninth paper products and pulp products, with a total export value reached US $ 5 billion / year.
The raw material for the pulp and paper industry are supplied from HTI APHI members, who strictly apply a policy of zero burning policy and chain of custody certification (Chain of Custody) and as well as legality certification of timber.
On the basis of that, the association hopes the HTI companies investigative process that become suppliers of Indonesian pulp and paper industry can be resolved through an agreement of AATHP.
